Liability & Risk Acknowledgment

We always do our best to make sure your expedition arrangements are satisfactory. However, we cannot accept liability of whatever nature for the acts, omissions or defaults, whether negligent or otherwise, of those principles providing services in connection with your expedition pursuant to a contract between themselves and yourself (which may be evidenced in writing by the issue of a ticket, voucher, coupon or the like) and over whom we have no direct or exclusive control. We do not accept any liability in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly by force majeure or other events which are beyond our control, including but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of government or any authorities, accidents to or failure of machinery or equipment. You understand that everything about this trip and your participation in it is to be considered "AT YOUR OWN RISK".

Deposit & Payment Terms

Except by special agreement in writing, a 50% deposit is due immediately at the time of booking. All deposits and payments to Mag Bay Tours are non-refundable. Mag Bay Tours purchases goods and services well in advance of your arrival and is therefore unable to refund any monies you have paid. The balance of the total cost is due ninety (90) days prior to departure. Failure by the client to pay the said balance payment by the due date will entitle the company to cancel all bookings made whereupon any deposit paid by the client shall be forfeited. Failure by the client to arrive on the dates booked will cause any deposits and payments made by the client to be forfeited.

Changes & Cancellations

Life with adventure often requires some changes. The company or principles have the right to cancel or alter any itinerary without notice as may be found necessary. ie: In a full group of 14 surfers there will always be 1 extra spot available for Mag Bay Tours "Gold Star Alumni" Members on a first come first served basis. Principles have sole discretion to decide the suitability or otherwise of climatic conditions, seas or other conditions for the normal performance of the tour. Any additional personal expenses incurred as a result of delay, including delay from mechanical breakdown will be the responsibility of the passenger. Refunds from Mag Bay Tours are not available for tours, accommodations, or any other services not utilized. Note: This is where travel insurance is beneficial.

Participation & Behavior

Company shall not be liable in the event that satisfactory conditions or activities are unavailable or that conditions are of too great a magnitude for a client to participate in an activity, tour, etc., or while their status, mental or physical condition is, in the opinion of the principal, such as to render them incapable of caring for themselves.

Orderly behavior is required and passengers shall comply with the instructions of the principles at all times. Passengers may not make themselves objectionable or become a hazard to anyone, themselves included. Objectionable passengers will be expelled and the company will not be responsible for expenses or damages incurred by such persons.

Travel Insurance

Monetary loss due to unexpected trip cancellation or interruption can happen so we strongly advise purchasing Travel Insurance. Please review your travel insurance policy for an exact description of benefits.

Costs Not Included in Tour Price

Airfare, excess baggage, travel insurance, custom "off day" transportation, airport departure taxes, passport and inoculation costs, tips and gratuities, souvenirs, hotel rooms, meals away from base camp, and any other expense not specifically listed as "included" in any of the company's literature/website/sales materials.
